Atlanta officer charged with murder in Rayshard Brooks shooting, could face death penalty

Officer Garrett Rolfe, the Atlanta Police officer who shot Rayshard Brooks in the back and killed him last week in a Wendy’s parking lot, was charged with felony murder and other charges, Fulton County District Attorney Paul Howard announced Wednesday.

Howard said Brooks never displayed aggressive behavior toward the officers during the 42-minute exchange. Howard said the officers failed to provide timely medical attention to Brooks after he was shot and that Rolfe kicked Brooks as he was lying on the ground, fighting for his life.

Rolfe faces up to life in prison or the death penalty if convicted.

Devin Brosman, the second officer, faces three charges carrying penalties of one to 20 years in prison. 

Officer Garrett Rolfe has already been fired, and officer Devin Brosnan has been put on administrative duty. Arrest warrants have been issued for the two and they were asked to surrender by Thursday.

Brosnan has agreed to testify against Rolfe.
